Registration of dispositions

Notaries and lawyers in Switzerland as well as Swiss authorities and official bodies can register the depository location of a testamentary disposition with the Register of Testaments.

 

 

Specifically, we register:

  • Holographic and publicly certified wills
  • Contracts of inheritance
  • Marital agreements
  • Contracts relating to registered partnerships
  • Precautionary order

 

The registered disposition must be kept by a recognised depository, which is to say a notary or lawyer in Switzerland or a Swiss authority or an official body. This ensures that the registered dispositions are located and executed in the event of death.

Precautionary dispositions can also be registered.

Search for dispositions (research)

You can request a search at ZTR for the testamentary dispositions of a deceased person. You must provide proof of legitimate interest to search for registered precautionary dispositions of a person.

 

Necessary information for a registration

ZTR requires the following information for a registration:

  • Type and date of disposition
  • Surname, birth name and first name of the person making the disposition
  • Date of birth
  • Home town (for Swiss citizens) OR nationality and country of birth (for foreign citizens)
  • Place of residence

Necessary documents for a research

In order to carry out your inquiry, ZTR requires the following details and documents:

  • Your full billing and delivery address.
  • An official death certificate issued by a competent authority: An extract for the deceased person with registration of death from the Swiss Civil Register Infostar (Infostar forms 2.2.1, 2.2.2, 2.80, 7.3 or 7.4) or a foreign civil register.
  • ZTR accepts clearly legible death certificates in German, French, Italian, English, Spanish, Portuguese and Dutch. Death certificates in any other language must be translated into one of the four languages used in the register (German, French, Italian or English).
  •  Communication of other personal data for the deceased person if necessary (e.g. previous names, last home address).

The web application eZTR

ZTR is now fully digital, which enables it to process applications quicker and more easily. The web application is only for notaries, lawyers, official bodies and employees of law firms that operate in Switzerland. There are two types of account:

 

Master account

Notaries, lawyers and official bodies can request a master account with ZTR. They are also the invoice recipients. You can request a new user account on the login page. With a master account, you can also manage your logins and provide your employees with access privileges.

 

Employee account

Employee accounts can ONLY be requested via a master account. In the process, these persons will be granted access to the data in the master account. This way, you are entitled to carry out registrations, researches and modifications for your notary or law firm.
